Casscado Terms and Conditions of Sale and Website Use

These Terms apply to:

  • casscado.com and its subdomains;
  • casscado.cz;
  • casscado.sk;
  • casscado.pl;
  • casscado.de;
  • casscado.co.uk; and
  • any other Casscado website or national domain that links to these Terms.

1. Scope

These Terms govern access to Casscado websites and purchases from Casscado.

By placing an order, you agree to these Terms, our Refund and Returns Policy, Shipping Policy and Privacy Policy.

If you are a consumer, nothing in these Terms limits any mandatory consumer rights granted by the laws of your country of residence.

Unless otherwise agreed in writing, the store is intended for consumers purchasing products for personal use rather than resale.

2. Minimum age

Nicotine products are strictly intended for adults.

To access age-restricted parts of the store or order nicotine products, you must:

  • be at least 18 years old; (or 21 for USA)
  • have reached any higher minimum legal age applicable in your country of residence or delivery country;
  • be legally permitted to purchase, possess and receive the product; and
  • not purchase the product for, or transfer it to, a minor.

Both the purchaser and the intended recipient must meet the applicable age requirement.

Providing false age, identity or delivery information, allowing another person to complete verification on your behalf, or attempting to purchase products for a minor is prohibited.

3. Age verification

Casscado may verify age when a customer enters the website, creates an account, checks out, before an order is dispatched or when an order is delivered.

Depending on the customer’s country and available national services, verification may be carried out using:

  • Adulto, including supported national electronic identity or age-verification methods;
  • Didit, where a suitable national verification method is unavailable; or
  • another equivalent verification provider identified during the verification process.

Verification may require information such as date of birth, electronic identity confirmation, an identity document, a photograph, facial age estimation or another legally accepted method.

Age-verification information is processed in accordance with our Privacy Policy and the privacy information displayed by the verification provider.

If you refuse verification, cannot complete it, provide inconsistent information or do not meet the applicable age requirement, we may reject or cancel the order. Any payment already collected will be refunded using the original payment method, subject only to deductions expressly permitted by law.

Successful verification does not authorize purchases or deliveries that are otherwise prohibited by applicable law.

4. Products and health information

Casscado may sell nicotine pouches, nicotine-free pouches, caffeine or energy pouches, oral-care products, accessories and other consumer products.

Nicotine warning: Nicotine products contain nicotine, which is a highly addictive substance. They are intended only for adults and should be kept out of the reach of children and pets.

Nicotine products are not medicinal products, smoking-cessation treatments or medical advice unless expressly identified otherwise.

Products containing caffeine are not recommended for children, pregnant or breastfeeding persons, or people sensitive to caffeine. Customers must follow the product label and must not exceed the recommended intake.

Do not use a product if its packaging or hygienic seal is damaged. Customers should read the ingredients, warnings, nicotine or caffeine strength and usage instructions before use.

Anyone with a medical condition, taking medication or uncertain whether a product is suitable should consult a qualified healthcare professional.

5. Product information

We aim to provide accurate product descriptions, ingredients, strength information, pouch counts, weights, images and prices.

Packaging, colours or graphic design may change when a manufacturer introduces new packaging. Product images are therefore illustrative unless expressly stated otherwise.

The information printed on the physical product, including ingredients, nicotine or caffeine content, allergens, expiry date and safety instructions, takes precedence over an outdated website image. If there is a material discrepancy, do not use the product and contact us.

Products must be stored and used according to the manufacturer’s instructions.

6. Geographic availability

A product being visible on a Casscado website does not necessarily mean it is available for lawful sale in every country.

We may restrict products, payment methods or delivery destinations based on local legislation, licensing requirements, age-verification availability, carrier restrictions or other legitimate compliance reasons.

We may reject or cancel an order if the sale, import, export, delivery or possession of the relevant product is prohibited or cannot lawfully be completed.

Customers must not bypass geographic restrictions by providing misleading information, using parcel-forwarding services or redirecting a parcel to a prohibited destination.

7. Orders and contract formation

Placing an order constitutes an offer to purchase the products in the order.

An automated acknowledgement that we received your order does not necessarily mean that the order has been accepted. The purchase contract is formed when we explicitly accept the order or confirm its dispatch.

Before acceptance, we may reject an order for legitimate reasons, including:

  • failed age or identity verification;
  • a legally restricted destination;
  • payment failure;
  • suspected fraud or unauthorized payment;
  • unavailable stock;
  • an incorrect or incomplete address;
  • an obvious pricing or product-information error; or
  • inability to fulfil the order lawfully.

If an order is rejected or lawfully cancelled after payment, the applicable amount will be refunded to the original payment method.

8. Prices, VAT and payment

Prices are displayed in the currency selected for the relevant market.

The total price, applicable VAT or other taxes, delivery charges and any other mandatory costs are displayed before the customer submits an order.

Available payment methods are shown at checkout. Payment providers may require additional security checks, including 3D Secure authentication.

If a displayed price is clearly and objectively incorrect, we may reject the order before acceptance. Mandatory consumer rights concerning pricing errors remain unaffected.

9. Promotions and multipacks

Discounts, promotional codes and multipack prices are subject to the conditions displayed with the offer.

Unless stated otherwise:

  • promotions cannot be exchanged for cash;
  • discount codes cannot be combined;
  • discounts apply only during the advertised period;
  • multipack discounts apply to the specific quantity and variant selected; and
  • returned items may reduce or remove a quantity-based discount when legally permitted.

10. Delivery

We deliver only to destinations and through delivery methods available at checkout.

Delivery dates are estimates unless expressly guaranteed. Further information is provided in our Shipping Policy.

The purchaser is responsible for providing a complete and accurate delivery address and contact details.

For age-restricted orders, the carrier or collection-point operator may require the recipient to:

  • be personally present;
  • present valid government-issued identification;
  • complete an age check; and
  • provide a signature.

The parcel may be refused or returned if the recipient cannot satisfy the applicable age requirement. Reasonable direct return or redelivery costs may be charged only where permitted by law and clearly disclosed.

For consumer orders, risk of accidental loss generally passes when the customer or a person designated by the customer physically receives the goods.

11. Cancellation, withdrawal and returns

Consumers have the withdrawal and return rights provided by applicable law.

For EU consumers, this generally includes the right to withdraw from an online purchase within 14 days after receiving the final item in the order. UK and other national consumer laws may provide equivalent or additional rights.

To withdraw, submit a return or cancellation request through your Casscado customer account or contact the email address associated with the domain used for the order.

The right of withdrawal may not apply to sealed goods that are unsuitable for return for genuine health-protection or hygiene reasons after their protective seal has been broken.

This may include opened or unsealed cans or packages of oral pouches and certain oral-care products. Opening the external delivery carton alone does not constitute unsealing the product.

Unopened products with their original hygienic and tamper-evident seals intact may be returned where the statutory withdrawal right applies.

These exceptions do not restrict rights relating to goods that are defective, damaged, incorrect or not as described.

Before returning goods, contact us to receive the correct return address and instructions. Failure to request instructions may delay processing but does not remove mandatory consumer rights.

The customer bears the direct return-delivery cost for a voluntary withdrawal unless we state otherwise. Casscado bears reasonable return costs for defective, damaged or incorrectly supplied products where required by law.

12. Defective, damaged or incorrect products

Customers are entitled to statutory remedies when goods are defective, damaged, incorrectly supplied or do not conform to the contract.

Contact us promptly and provide:

  • the order number;
  • a description of the issue;
  • photographs of the product and packaging;
  • the batch or lot number where relevant; and
  • the expiry or best-before date where relevant.

Statutory rights are not affected by any manufacturer’s warranty.

Normal consumption, improper storage, failure to follow instructions or use after an indicated expiry date is not a product defect unless the problem existed when the goods were delivered.

13. Accounts and prohibited conduct

You must provide accurate information and keep your account secure.

You must not:

  • impersonate another person;
  • make purchases for minors;
  • circumvent age or geographic restrictions;
  • use stolen or unauthorized payment methods;
  • interfere with the store or its security;
  • use automated purchasing tools without permission;
  • submit fraudulent complaints or chargebacks; or
  • use Casscado websites for unlawful activity.

We may restrict an account or order where reasonably necessary to prevent fraud, protect customers or comply with the law.

14. Intellectual property

Casscado’s brand, website design, text, graphics, photographs and other content are owned by or licensed to Casscado.

Content may not be copied, republished, sold or commercially exploited without written permission, except where allowed by law.

Third-party product names and trademarks belong to their respective owners.

15. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

Casscado is not responsible for losses caused by:

  • use contrary to the product label;
  • providing false age, identity or address information;
  • unauthorized transfer of products to minors;
  • unlawful import, redirection or resale by the customer; or
  • circumstances outside Casscado’s reasonable control,

except where Casscado is legally responsible for the loss.

16. Privacy and verification providers

Personal data is processed in accordance with our Privacy Policy.

To process orders, Casscado may share necessary information with Shopify, payment providers, fulfilment partners, carriers, Adulto, Didit and other service providers.

Age-verification providers may process identity-document, age-estimation or electronic-identity information. The information collected, retention period and verification method depend on the provider and country.

Where possible, Casscado receives only the verification result, reference and limited information necessary to demonstrate compliance rather than a complete copy of the customer’s identity document.

17. Changes to these Terms

We may update these Terms to reflect changes in products, services, technology or applicable law.

The Terms applicable to an order are generally the version in force when the order was placed. Changes do not retroactively reduce statutory rights relating to an existing order.
